Premise
These general online sales conditions (hereinafter "GSC") govern the sales contract (hereinafter, the "Contract") of the products (hereinafter, the "product" or the "products") offered by FIP Srl. - Share Capital €1,345,000 with registered office in Capo d'Orlando, Via Consolare Antica, 402, Tax Code/VAT No. 01388530832, registered with the REA of Messina No. 118014 (hereinafter, "FIP") - through its website www.porteitaliane.com (hereinafter, the "site") to the users of the site (hereinafter, the "customers" or the "customer").
These general sales conditions are intended to apply solely and exclusively to customers who qualify as "consumers" as defined by Art. 3, para. 1, lett. a), of Legislative Decree 6 September 2005, no. 206, i.e., "natural persons acting for purposes unrelated to their entrepreneurial or professional activity," and who are of legal age.
All information on the site is provided in Italian. The customer declares that they have read all the aforementioned information and general sales conditions before placing the order.
Before placing the product order, the customer declares that the purchase of the said product is not directly related to their professional activity, as the purchase is intended for personal use.
The customer also declares to have the legal capacity to commit to these general conditions.
1 - Object
These general sales conditions define the rights and obligations of the parties in the context of a distance sale of goods offered in the online store www.porteitaliane.com
2 - Territory and Scope of the Offer
This version of the general sales conditions applies exclusively to sales made to consumers with their domicile or residence in Italy.
3 - Contractual Documents
This contract consists of the following documents:
• these general sales conditions
• the order confirmation
The photographs illustrating the products on the site do not fall within the contractual scope and are provided for descriptive purposes only.
4 - Order Receipt
Any order confirmation signed by the validation click constitutes an irrevocable commitment of the customer that can only be questioned in the cases provided for in this contract in the articles "Right of Withdrawal" and "Order Execution".
5 - Order Acceptance
The conclusion of the contract will only occur when FIP SRL confirms the order.
The customer will receive an email notification of receipt containing the order confirmation with all the constitutive elements of the contract (including ordered products, prices, delivery dates, shipping costs).
FIP SRL reserves the right to not confirm an order for any reason related in particular to a problem with product supply, or a problem regarding the received order.
FIP SRL cannot be held responsible for errors in delivery due to inaccuracies or incompleteness in filling out the purchase order by the customer.
FIP SRL cannot also be held responsible for damages occurring to the products after delivery to the carrier responsible for their transport or for delays in delivery attributable to the latter.
6 - Product Availability
The offers contained on this site will be valid as long as the listed products are online and while stocks last. It should be noted that many of the products online are made to order by our customers; not all products are in stock.
FIP SRL also reserves the right to inform the customer, at the email address associated with their profile, of the unavailability of one or more of the purchased products. In the case of the purchase of a product that is no longer available, FIP SRL will refund (to the payment card or PayPal account indicated for the purchase or via bank transfer whose details will be communicated later) the price and shipping costs incurred by the customer.
7 - Prices - Invoice
Prices are expressed in Euros and exclude VAT.
The guaranteed price to the buyer is the one published on the site at the time of submission.
The product prices are final. They do not include any delivery costs, which will be indicated in the order confirmation. The initial price to which the discount is applied is the official list price provided by the brand. For some products with considerable off-sizes, an additional charge may apply, which will still be communicated to the customer who will decide whether to proceed with the order or cancel it without any penalty.
8 - Payment
The customer who intends to proceed with the purchase of products must express this willingness through a request made directly on the site, in the dedicated section, where, following the indicated procedures, they will send their purchase order and make the payment.
The payment of the fee is due from the moment of the order. The customer undertakes to pay the agreed price for the ordered product on the site (product price and transport) using the available payment methods.
The customer guarantees to FIP SRL to have the necessary authorizations to use the payment method indicated at the order stage.
If FIP SRL does not receive the payment, it reserves the right to cancel the order. In case of payment by credit card, FIP SRL reserves the right to request the sending, within 24 hours, of a copy of the identity document proving the actual ownership of the credit card used, it being understood that, in the absence of the requested sending, FIP SRL may refuse the payment and cancel the order.
Payment data will be processed through a secure server-to-server connection using the SSL (Secure Sockets Layer) Protocol.
9 - Risk Transfer
The transfer of risks to the customer occurs upon delivery of the products to the carrier by FIP SRL. During the withdrawal period mentioned in Article 13, the customer is responsible for the item as a custodian. In case of damage or destruction of the product during the custody of the customer, the latter will bear all the consequences.
10 - Order Execution
The order will be executed within the terms specified on the Site and upon acceptance of the order by FIP SRL and in any case within 30 days following the confirmation of the order subject to the availability of the ordered product and unless otherwise agreed between the parties.
In case of stock depletion or unavailability of the ordered product, FIP SRL undertakes to inform the customer as soon as possible and to specify a possible renewed availability date.

11 - Delivery
The geographical delivery area corresponds to the geographical area of the offer coverage. Deliveries are made from Monday to Friday.
The products are delivered to the address indicated by the customer. Delivery is intended at street level unless otherwise indicated. The request for delivery to the floor of an order (where available) must be indicated by the customer when confirming the order. Unless otherwise specified at the time of purchase, FIP SRL does not provide an installation service for the sold products.
FIP SRL, subject to the provisions of Art. 6, undertakes to deliver the products to the address communicated by the customer in the purchase order, through the carrier responsible for their transport. FIP SRL cannot be held responsible for delivery errors due to inaccuracies or incompleteness in filling out the purchase order by the customer. FIP SRL cannot also be held responsible for damages occurring to the products after delivery to the carrier responsible for their transport or for delays in delivery attributable to the latter.
FIP SRL delivers throughout the Italian territory. Deliveries to inconvenient ZIP codes (e.g., Venice Lagoon, Minor Islands) may involve variations in the indicated transport rates.
If the customer intends to place a purchase order through the site from abroad, they must necessarily provide a delivery address in Italy. Delivery is made through couriers selected by FIP SRL; PO Boxes are not considered valid addresses for delivery purposes.
The delivery document issued by the carrier, dated and signed by the customer upon delivery of the product, will constitute proof of transport and release of the good.
Upon delivery, the customer must verify the content, conformity, and condition of the product(s).
In case of delays, damages, total or partial losses, or other problems, the customer has the right to appeal to the carrier without FIP SRL's liability ever being invoked.
Therefore, upon delivery, FIP SRL recommends the customer to check the condition of the delivered products before signing the receipt document.
If anomalies are found, the customer must refuse the delivery of the products or write their reservations, detailed and dated, in writing.
12 - Product Pickup in Case of Customer Absence
In case of absence of the recipient during the delivery, the carrier will leave a notice at the delivery address indicated by the customer. In case of the recipient's absence also at the second delivery attempt, the products must be picked up at the address and according to the modalities indicated by the carrier.
In case of non-collection within the term established by the carrier, the products will be returned to FIP SRL which reserves the right to refund the product price, leaving the shipping costs to be borne by the customer.
14 - Use of the Site
The photographs and videos presenting the products accompanying the descriptive information are published on the site for descriptive purposes, considering that the quality of the images, including an exact display of the color variants, may depend on software and computer tools used by the customer at the time of connection to the site. FIP SRL assumes no responsibility for problems caused to the customer by the use of the site and the technologies employed as they are beyond its control.
15 - Intellectual and Industrial Property Rights
FIP SRL informs that the site, as well as all trademarks and distinctive signs used in connection with the sale of the offered products, are protected by applicable intellectual and industrial property rights and that any reproduction, communication, distribution, publication, alteration, or transformation, in any form and for any purpose, is prohibited. FIP SRL reserves the right to take legal action to protect these aspects. FIP SRL assumes no responsibility for trademarks and other distinctive signs appearing on the products it markets on the site, which the customer does not acquire any rights to following the conclusion of the Contract.
16 - Personal Data Protection
FIP SRL is the owner of the personal data collected at the time of registration on the site, as well as those subsequently communicated at the time of purchase by the customer, except for the data relating to the payment procedure for which reference is made to the banks through which the transaction takes place. 18 - Electronic Signature
The "validation click" constitutes an electronic signature.
This electronic signature has the same value between the parties as a handwritten signature.
19 - Contract Integrity
These general sales conditions constitute all the obligations of the parties.
No other general or particular condition communicated by the customer can be inserted or depart from these general conditions.
20 - Nullity
If one or more provisions of these general conditions are deemed invalid or declared as such pursuant to a law, regulation, or following a final decision by a competent jurisdiction, the other provisions will retain their full force and value.

21 - Applicable Law
The sales contract between the Customer and FIP SRL Srl is understood to be concluded in Italy and governed by Italian law. Any dispute relating to the purchase of the product involving the Manufacturer must be brought before the Court of Patti, exclusively competent, which must apply the rules of Italian law.
Any dispute between the User and the Manufacturer must be preceded by the initiation of a mediation procedure to be carried out before the INMEDIAR (National Institute for Mediation and Arbitration).
